Did you know...?

 

Under Kansas Workers’ Compensation Amendments 2005:

 

KSA 44-501(b)(3).  An employer now has probable cause to test an employee if (1) employer requires the drug testing and the policy was set in writing prior to the date or accident; or (2) the testing was done in the normal course of medical treatment for reasons related to health and welfare of the worker; or (3) the injured worker had given written consent for a drug or alcohol test prior to the accident requiring medical treatment but then refused testing after such accident.  This refusal shall be considered evidence of impairment; however, there must be evidence that the presumed impairment attributed to the accident or that the testing was done as a result of federal or state law or federal or state regulation that required post accident testing.
